Welcome to Swaragh Technologies. These Terms of Service ("Terms") govern your use of our website design & development, digital branding(logo & digital materials - such as brochures, business cards, letterheads, web banners, social media graphics, and presentations), hosting(shared, vps, cloud, dedicated), domain registration, web application and mobile application services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.
1. Nature of Services
Swaragh Technologies provides professional IT services including, but not limited to, web design, application development, and third-party hosting/domain management.
2. Client Responsibilities
- Content Ownership: You represent that all text, graphics, and data provided to us are owned by you or you have permission to use them.
- Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
- Account Security: While we may perform routine backups, you are primarily responsible for maintaining independent archival copies of your data.
3. Hosting and Domain Management
- Third-Party Dependence: You acknowledge that Swaragh Technologies procures hosting space and domain registrations from third-party vendors (e.g., AWS, Azure, Google Cloud, GoDaddy, Hostinger, etc.). Your use of these services is strictly subject to the Terms of Service and Acceptable Use Policies of these third-party providers.
- Uptime & Service Levels: We utilize third-party infrastructure for hosting. While we strive for 99.9% uptime, we are not liable for outages, downtime, or service interruptions caused by upstream providers, global network failures, or maintenance by third-party vendors.
- Pass-Through Liability: Any downtime, data loss, account suspension, or technical limitations imposed by the third-party provider are beyond our control. Swaragh Technologies shall not be held liable for any losses arising from the actions, negligence, or service failures of these third-party vendors.
- Price Fluctuations: Domain and hosting renewal prices are subject to change based on the third-party vendor's pricing and prevailing currency exchange rates at the time of renewal.
- Renewal Responsibility: While we may send courtesy reminders via email, the ultimate responsibility for timely renewal rests with the Client. Swaragh Technologies is not responsible for the loss of a domain name, website data, or business interruption due to expired services or non-payment.
4. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWARAGH TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION.
- Financial Cap: Our total liability for any claim shall not exceed the amount actually paid by you for the specific service during the six (6) months immediately preceding the claim.
- "As Is" Basis: All services are provided "as is" without any express or implied warranties.
5. Indemnification
You agree to indemnify and hold harmless Swaragh Technologies and its partners/directors, and employees from any claims, losses, or legal fees arising from (i) your breach of these Terms, (ii) illegal content hosted on your site, or (iii) your violation of third-party intellectual property rights.
6. Prohibited Activities (Acceptable Use Policy)
You agree not to use our Services to:
- Host or transmit Obscene, Pornographic, or Illegal content under Indian Law.
- Engage in spamming, hacking, or distributing malware.
- Violate the sovereignty or integrity of India.
7. Grievance Redressal Mechanism
In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have appointed a Grievance Officer to handle complaints regarding hosted content or service issues.

8. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
